In accordance with art. 52 of Legislative Decree no. 206 of September 6, 2005 (the "Consumer Code"), you have the right to terminate the contract with TESSIT without penalty and without giving any reason, within 30 days from the day on which you received the products purchased on tessit.it.
In accordance with art. 54 of the Consumer Code, you can exercise the right of withdrawal using, at your option, one of the following methods:
a) online transmission to the Seller of the return form or by sending an email to firstname.lastname@example.org; in this case, the Seller will send you confirmation by email of receipt of the declaration of withdrawal;
b) sending by mail to the Seller another explicit declaration of your decision to withdraw from the contract.
Your declaration must be sent for the attention of Customer Service to the registered office of Tessit, via Roma 89, 39100 Bolzano. It is understood that, in this case, you will have to prove the correct and timely exercise of the right of withdrawal.
In accordance with art. 57 of the Consumer Code, once you have exercised your right to withdraw from the contract, the products to be returned must be delivered to the courier within fourteen (14) days from the date on which you informed the Seller of your decision to withdraw from the contract.
In accordance with art. 59 of the Consumer Code, the right of withdrawal is excluded if you have purchased custom-made or personalized products or sealed goods that are not suitable to be returned for hygienic or health protection reasons and have been opened after delivery.
1. Conditions for the exercise of the right of withdrawal in accordance with Article 52 of the Consumer Code
The right of withdrawal is considered properly exercised if the following conditions are fully respected:
a. the right of withdrawal must be duly exercised within thirty (30) days of receipt of the products by following one of the methods indicated above;
b. the products must not have been used, worn, washed and, in any case, must comply with the requirements specified in art. 3, which follows, on the verification of conformity of returned products;
c. the products must be returned in their original packaging (if you want to return a kit, you must return all the items that make it up);
d. the returned products must be delivered to the forwarding agent within fourteen (14) days starting from when you have informed the Seller of your decision to withdraw from the contract;
e. the products must not be damaged. If you have complied with all the conditions required, the Seller, in accordance with art. 56 of the Consumer Code, will refund the full price of the products purchased, you will be responsible only for the costs of return, ie those for returning the purchased products to the Seller, unless the Seller has expressly exempted you from these costs at the time of purchase and on the further condition that you use the carrier and shipping methods suggested by the Seller in paragraph 2 below.
2. Modalities for returning products to the Seller
The Seller suggests using the forwarding agent GLS for the return of the purchased products. If you decide to use GLS for the shipment and to use the label that you will receive by email with the return address, you will not have to pay the return costs yourself. In fact, the Seller will pay the courier on your behalf, withholding from your refund a lump sum equal to the cost previously incurred for the delivery of the purchased products to your home. This method of shipment also allows you to verify, at any time, where each package is, freeing you from any liability in case of loss or damage of products during transport. If you decide to use a forwarding agent other than GLS, you will have to pay the return shipping costs yourself and you will be responsible for any loss or damage to the products during transport. It is understood that, in this case, an amount equivalent to the cost of standard shipment of the purchased products will be refunded, while, in accordance with art. 56, paragraph 2, of the Consumer Code, any additional costs incurred by you for having chosen a different and/or faster type of shipment and delivery than the standard one will not be refunded.
3. Verification of conformity of returned products
You will be contacted if your return can not be accepted because it does not comply with the conditions referred to in letters. a) and d) of paragraph 1 above or in the event referred to in art. 59 of the Consumer Code and you can choose to return the products purchased at your expense. If you refuse this shipment the Seller reserves the right to retain the products and the amount corresponding to the purchase price of the products.
All products must be returned new and unused, in perfect condition, with all protective materials and with the identification tags and stickers attached to the products (if any), as well as their packaging, accessories and documentation. If the product shows signs of use or has been used or altered from its original condition in any way, Seller reserves the right not to accept the return or, alternatively, to reduce the refund or exchange amount accordingly.
For example, the Seller may make a curtailment of the refund under the following circumstances:
- the products have been used, worn, damaged or washed;
- the identification tag is no longer attached to the products with the disposable seal or has not been returned. Please note that the ID tag is an integral part of each product; and/or
- the original packaging that is an integral part of the product (e.g., the protective bag) has not been returned;
You will be contacted if the Seller decides to deduct the refund for this reason. In this case, you can choose (as an alternative to the curtailment of the refund) to have the purchased products back at your expense. In this last case, if you refuse the shipment, the Seller will be entitled to retain the products and the amount indicated for the reduction of the refund, due to the decrease in value of the returned products.
The Seller assumes no responsibility in case of products returned by mistake or items forgotten in the packages or products returned.
4. Refund times and procedures
After the Seller has received your return and checked that all requirements have been met, you will receive an e-mail confirming acceptance of the return and TESSIT will proceed with the full refund, or, if it is found that there is a decrease in the value of the returned products, you will receive an e-mail informing you of the amount deducted as a reduction of the refund and TESSIT will refund the amount due. Whatever method of payment you used among those available, the refund is activated by the Seller as soon as possible, and in any case within fourteen (14) days from the date on which he became aware of the exercise of your right of withdrawal, once verified that the withdrawal has taken place in accordance with the conditions described above.
The actual time for the re-credit or refund of the sums paid by you for the purchase of products depends on the method of payment used:
- purchase by credit/debit card: the refund time depends on the credit/debit card management company, but normally takes place within two statements. Please note that the value date of the re-credit is the same as the debit, so you will not suffer any loss in terms of bank interest;
- purchase via PayPal (if available): the refund will be made on your PayPal account and will be immediately visible. The actual refund to the credit card from your PayPal account depends on the institution that issued the card;
- cash on delivery (if available): the reimbursement will be made on the bank account indicated by you, so the time of reimbursement depends on the correctness of the data you enter; normally the re-credit is made within fourteen (14) days.
In case of gift, the reimbursement of the sums will be executed towards who has effected the payment.
5. Products affected by defects or non-compliant
Without prejudice to the application of mandatory rules for the protection of consumers, you can return a product because it is defective or does not conform to what was ordered, informing the Seller, within thirty (30) days from the day you received the products purchased on tessit.it; if the defect appears after thirty (30) days, contact Customer Service for more information. For how to return products, check sections 1 and 2.
TESSIT will check the products you have returned because they are defective or do not conform to what you ordered and will proceed to refund you in full, including shipping costs and expenses you incurred to return the products to TESSIT.
In the event that TESSIT does not detect any defect or lack of conformity in the returned products, you will be informed that your return cannot be accepted and you may choose whether to have the purchased products back. If you refuse the shipment, TESSIT will be entitled to retain the products and the amount corresponding to the purchase price of the products, and reserves the right to claim the costs incurred.
6. Conditions for the exchange of products
In some cases, as specified below, you will have the opportunity to exchange the products purchased with others of the same model, with different size and/or color. The exchange of products will only be possible if the products in the selected size and/or color are available at the Seller's warehouses.
The request for exchange will take place within the limits provided below:
- you may request the exchange of one or more products purchased only with products of the same model, having a different size and/or color.
- you may request an exchange of one or more products purchased within and no later than thirty (30) days from the date of their delivery, by sending an e-mail request to TESSIT within the aforementioned period. The products to be exchanged must be delivered to the courier within fourteen (14) days from when you have informed the Seller of your decision to exchange the products;
- you may only make one exchange request per product purchased;
- the products for which you request an exchange must be returned to TESSIT in their original packaging, unused, unworn, washed or damaged, and the identification tag must still be attached with the disposable seal;
- the products to be exchanged that are part of a single order must be sent to TESSIT in a single shipment. TESSIT, in fact, reserves the right not to accept products of the same order, sent for exchange at different times.
If all the above mentioned conditions are correctly respected, once sent the email containing your exchange request, TESSIT will take care of the same exchange request by sending you a confirmation email to that effect.
After TESSIT has received the products you intend to change and checked that all the requirements set out above have been met, TESSIT will check the actual availability in its stores of products in the size and / or color you have selected.
If the product or products selected for exchange are not available in its stores, TESSIT can not accept your request for exchange and will therefore refund the price of the product or products originally purchased and not replaceable, in accordance with the provisions of the Consumer Code and in the manner provided above.
In the event that the product or products selected for exchange are available, TESSIT can accept your request for exchange and will therefore proceed to send you an e-mail confirming the shipment of replacement products. The shipment will take place in this case within thirty (30) working days from the date on which TESSIT will be aware of your request for exchange. The shipping costs of the replacement products will be borne by TESSIT.
Where the price of the product purchased is lower or higher than the price of the product selected for the exchange, you will not be entitled to any refund and / or charge for the difference. However, as an alternative to the request for replacement of the product, you can exercise your right to return in accordance with the Consumer Code.
You will be contacted if your exchange request cannot be accepted because it does not comply with the above conditions. In this case, you can choose to have the products you intended to change back at your expense. In the event that you refuse this shipment, TESSIT reserves the right to retain the products and may also retain the amount corresponding to the purchase price of the products themselves, or the amount indicated for the reduction of the refund, due to the decrease in value of the returned products, as indicated above. The replacement product or products may be subject to subsequent restitution pursuant to art. 52 of the Consumer Code.

These Conditions for the exercise of the right of withdrawal, an integral part of the General Conditions of Sale, are governed by Italian law and in particular the Consumer Code.
